As a condition of purchasing gender SELECTed™ semen, the purchaser agrees that gender SELECTed™ semen will not be reverse sorted or re-sorted unless specifically permitted, in advance, on a case-by-case basis by Select Sires in writing. This prohibition extends to the resale or transfer of gender SELECTed™ semen. Select Sires reserves all rights, claims and remedies, including rescission, afforded it under the law, for any failure to follow the foregoing prohibitions; provided further that if any male bovine offspring results from actions taken in violation of the prohibition on reverse sorting and re-sorting, the male bovine offspring may not be used for commercial breeding purposes.
